Many Actos lawsuits have already been filed against the drug manufacturer Takeda Pharmaceuticals.  Most involve claims of liability due to negligence by failing to inform the public that use of Actos may be linked to bladder cancer.  Lawsuit judgments sought are high dollar amounts; damage claims are for strict liability, negligence in design and failure to warn the public, breach of express and implied warranties, misrepresentation and violation of state laws.  Survivors and spouses are claiming for their loss of consortium and other damages.

Is there an Actos Recall?
Despite evidence of increased risk for bladder cancer, there has not been an official recall yet for the drug Actos (Pioglitazone HCL).  Used by adults afflicted with type 2 diabetes, Actos reduces sugar (glucose) levels in the blood.  This is very important for diabetics, and some may only have success with Actos.  In Europe, drug regulators are not recalling Actos, but they have told doctors to recommend the drug as a last resort for diabetics.  In France, the drug sales have been suspended.  German authorities have recommended not using this drug for new patients. The U.S. has yet to issue a recall for Actos, and it is not recommended for use by persons that already have or that have previously had bladder cancer.

Are there Safety Warnings for Actos from the FDA?
Yes, the FDA has issued a safety announcement with regard to Actos.  On June 15, 2011, the U.S. Food and Drug Administration warned the public that persons most at risk for Actos-related bladder cancer are those that have used that drug for a period of one year or longer.  In addition, there now is a requirement to add this warning to drug labels for Actos and other drugs that contain Actos.

How Many People are At Risk?
Pioglitazone products including Actos were prescribed in the first ten months of 2010 to about 2.3 million persons.  The ingredient appears to have a cumulative effect, as shown in a ten-year study of the drug.  Persons at highest risk are those that have taken the drug the longest, over one year.
